Disclaimer and Privacy Policy

These General Conditions regulate use of the website http://www.secuoya.es (hereafter, the Portal), which the Portal owner (1) makes available to internet users (hereafter, the User(s)). Browsing and/or use of the Portal and its services imply the User’s unreserved acceptance of the General Conditions set out here, which the User must read each time they intend to use the Portal, as well as any other specific Conditions which may be established, in order to regulate the services provided by SECUOYA, and inform Users of them, as well as allowing the provision of its services through the Portal.

GENERAL CONDITIONS

1.- Ownership of the Portal

In compliance with the duty of information set out in article 10 of Law 34/2002 of the 11th of July on Information Society Services and Electronic Commerce, the following information is highlighted: The company which owns this Portal is SECUOYA GRUPO DE COMUNICACIÓN, S.A. (SECUOYA) with registered office in Granada, Gran Vía de Colón, n° 12 3ª Planta B, with CIF tax identification number A-18.859.520, registered in the Commercial Register of Granada in Volume 1.384, Sheet 215, Page – 34.791, Entry 1ª.

2.- Industrial and Intellectual Property.

2.1 Industrial and Intellectual Property

All images, elements and content included on the Portal, in particular brands, commercial names, industrial designs and models, drawings, texts, photographs, graphics, logos, icons, software and any other symbols or products susceptible to industrial and commercial use are the property of SECUOYA or their respective owners, who have authorised their inclusion on the Portal, and are protected by current legislation.

The User’s access and browsing of the Portal does not imply authorisation or waiver, transfer and/or granting, fully or partially, of any right of SECUOYA or third parties, or the transfer of any right or expectation on them, specifically, reproduction, distribution, public communication or transformation or exploitation of the Portal or its images, elements and content, unless with express written authorisation from SECUOYA. Their usage, use and/or reproduction without the express consent of SECUOYA is therefore prohibited.

2.2 Liability for infringement

SECUOYA will not be liable for Users’ infringements of intellectual, industrial or image property rights of third parties which may arise from inclusion of brands, commercial names, industrial designs and models, drawings, texts, photographs, graphics, logos, icons, software and any other symbols or products susceptible to industrial and commercial use on the Portal, which belong to third parties which have declared ownership of them upon including them on the Portal.

3.- Personal Data Protection

3.1. Information and registration of files

In accordance with Regulation (EU) 2016/679 of the European Parliament and Council (GDPR) of the 27th of April 2016 on the protection of natural persons with regard to the processing of personal data, SECUOYA informs Users of this Portal of the existence of a personal data file owned by SECUOYA, into which the data obtained through the Portal will be incorporated, under its responsibility, for the purpose of maintaining the commercial relationship and communication on our services.

3.2. Purpose of the File

The purpose of incorporating the User’s personal data into the file is the appropriate processing and management of the requests of Users with regard to the services offered on the Portal, allowing the management of their requests through the service, and carrying out notifications and/or informative and commercial actions on products and services, using means such as email and mobile phone communication, among other means to do so, on behalf of SECUOYA and companies which form part of its Business Group (Secuoya Grupo de Comunicación: https://gruposecuoya.es).

SECUOYA is committed to using the data in accordance with the purpose of the file, and respecting their confidentiality. The recipients of the information will be those in charge of the SECUOYA marketing department.

3.3 Consent of the User

The User accepts the inclusion of the data collected during browsing the Portal, as well as those provided through completion of the form on which they are entered, as well as those derived from potential commercial relationships which may arise, in the corresponding SECUOYA personal data file, by virtue of the express consent provided through the website.

During the data collection process, in the section of the Portal where it is requested, the User will be appropriately informed by a hyperlink or through the inclusion of the information on the form itself, of the obligatory or non-obligatory nature of the collection of this data for the provision of services, as well as their rights.

3.4 Rights of the User

With regard to the data collected, the User may exercise the rights established in Regulation (EU) 2016/679 of the European Parliament and Council (GDPR) of the 27th of April 2016, particularly the rights of access, rectification or deletion, limitation and portability of data, as well as withdrawal of consent to the transfer of their data or for any of the uses described above.

The rights to which the previous paragraph refers may be exercised by the User by request sent to SECUOYA, a Spanish company with registered office in Gran Vía de Colón, n° 4 2ª Planta, with CIF tax identification number B- 19519438 or by sending an email to (info@gruposecuoya.es).

4.- Commercial communications.

The User authorises SECUOYA to send commercial communications by any means with regard to current legislation on personal data protection and by virtue of the express consent obtained through the website.

For commercial communications made by email and equivalent means, in compliance with Law 34/2002 on Information Society Services and Electronic Commerce, the User’s consent must be duly obtained when the corresponding data is collected.

The User may withdraw their consent to receive the communications at any time by notifying SECUOYA (info@gruposecuoya.es).

5.- Responsibility of SECUOYA.

SECUOYA makes its best efforts for all content and services included on the Portal to be reliable and adequate, and declares having adopted all necessary means, within its capabilities and the state of technology, to guarantee the proper operation of the Portal and avoid the existence and transmission of viruses and other components which may be damaging to the user.

The User acknowledges and accepts that access and/or use of the Portal and its services is carried out under their full responsibility. Therefore, any access or use of the Portal and/or the Portal content which does not comply with these conditions is the exclusive responsibility of the individual undertaking it. SECUOYA will therefore not be liable for any consequence, damage or harm of any nature that the User may experience as a result of the use of the Portal, such as errors or omissions in content, completeness, accuracy, timeliness, lack of availability of the portal or transmission of viruses, despite having adopted all technological means possible to avoid them.

6.- Modifications to the Portal.

SECUOYA reserves the right to make modifications to the Portal or any of the Portal’s browsing and/or usage conditions at any time and without prior notification or authorisation of the User through the publication of these modifications on the Portal, accessible by Users, being able to change, delete or add both content and services provided through it and the form in which these are presented or located on its Portal.

7.- Link and hyperlink policy.

7.1 Links and/or hyperlinks on the Portal

In case of the Portal having links and/or hyperlinks to other websites, SECUOYA will not exercise any control over these sites or their content. SECUOYA will in no case assume any liability for the content of any link to an external website, or the infringement of third party rights contained on these websites, or guarantee the technical availability, quality, reliability, accuracy, extent, veracity, validity or constitutionality of any material or information contained on any of these hyperlinks or other websites. Likewise, the inclusion of these external connections will not imply any kind of association, consolidation or involvement with the connected entities.

7.2. Links and/or hyperlinks to the Portal

Any authorised link from third parties to the Portal must be to its homepage, “deep links”, “framing” and any other use of the website content for the benefit of unauthorised third parties is expressly prohibited. The page containing the link must not make any kind of false, imprecise or incorrect statement about SECUOYA, its partners, employees, clients or the quality of the services it provides. In no case will it be stated on the page containing the link that SECUOYA has provided its consent to the insertion of the link or that it otherwise sponsors, collaborates with, verifies or monitors the services of the sender. The page that establishes the link must strictly comply with the law, and may in no case offer or link to own or third party content which is illicit, harmful or contrary to morality or decency, or be inappropriate and come into conflict with the activity of SECUOYA.

8.- Acceptance of the General Conditions.

8.1 General acceptance

The User accepts the General Conditions established and is committed to using the content of the Portal diligently, correctly and legally and will refrain from:

  • Reproducing, distributing, publicly communicating or transforming or modifying content, unless authorised to do so by its owner.
  • Using any content of the Portal to send advertising, commercial communications of any kind, unsolicited communications addressed to a large number of people, or commercialising or disclosing this information in any way.
  • Using the content in a manner contrary to the law, public order, morality and decency.

The User will be liable to SECUOYA or third parties for any liquidated damages which may arise from non-compliance with these obligations.

8.2 Code of conduct for SECUOYA Chats, Blogs and Forums.

The User is committed to using the chat, blog and forum services of the Portal in accordance with the law and these General Conditions on use of the Portal, as well as morality, generally accepted decency and public order. SECUOYA informs Users that usernames (“Nick”) are freely selected by each User, and therefore does not guarantee that the Nicks correspond with the true identities of the people who use them. SECUOYA is not liable for the opinions, information or content transmitted by users through the Services. SECUOYA does not monitor the Users’ use of the Services, therefore the Users are exclusively responsible for messages or content published, and liable for liquidated damages of all kinds that SECUOYA may suffer as a result of non-compliance with these General Conditions or the law. SECUOYA reserves the right to remove messages contrary to the General Conditions for use of the Portal or current legislation at any time, under its own criteria.

9.- Applicable legislation and jurisdiction

The applicable legislation governing the relationship between the User and the owner of the Portal will be Spanish law.

For the resolution of any dispute which may arise, SECUOYA and the User voluntarily subject themselves to the Courts and Tribunals of Madrid, expressly waiving any other jurisdiction which may correspond to them.
